These Terms and Conditions govern your purchase of, access to, and participation in Product Pathways online courses, cohort programs, coaching services, and private communities.
By purchasing or accessing any Product Pathways Service, you agree to be bound by these Terms.
In these Terms:
- "We", "Us", "Our" means Product Pathways Pty Ltd (ABN 99 656 840 194).
- "You", "User" means the individual or entity purchasing or accessing the Services.
- "Services" means any online course, cohort-based program, coaching session, workshop, digital resource, or private community access provided by Product Pathways.
- "Content" means all materials provided as part of the Services, including videos, recordings, templates, frameworks, written materials, and community posts.
- "Community" means any private forum, group, chat space, or platform operated or moderated by Product Pathways.
- "Platform" means our website and any third-party platforms used to deliver Services.
All Services are provided for educational and informational purposes only. They are not professional, financial, legal, or business advice.
We do not guarantee:
- business results
- revenue outcomes
- career advancement
- skill acquisition
- certification or employment
Your outcomes depend on factors outside our control, including your effort, experience, context, and market conditions.
Where coaching, feedback, or live guidance is included:
- it is general in nature
- it does not create a consultant-client relationship
- you remain responsible for all decisions and actions taken
Upon purchase, you are granted a limited, non-exclusive, non-transferable, revocable licence to access the Services for your personal use only.
Access duration is as stated on the relevant sales page at the time of purchase. Where "lifetime access" is offered, this means access for as long as the Service and Platform continue to be offered by Product Pathways.
We reserve the right to modify, update, replace, or retire Content at any time. This includes changing formats, updating materials to reflect current practices, consolidating modules, or discontinuing specific resources. Your access is to the Service as it exists from time to time, not to any particular version of Content. We are not obligated to maintain, archive, or provide access to previous versions of any Content.
You must not:
- share login details
- distribute or resell Content
- record live sessions without permission
- reproduce or commercialise Content
- provide access to any third party
We reserve the right to suspend or terminate access for breach.
Live sessions may be delivered online and scheduled at our discretion. We may:
- reschedule sessions where reasonably required
- substitute recordings where live delivery is not possible
We are not required to:
- repeat sessions
- provide make-ups
- offer partial refunds for missed attendance
Coaching sessions must be scheduled in accordance with the booking process communicated to you. Sessions are subject to availability. Cancellation or rescheduling of coaching sessions requires at least 24 hours' notice. Sessions cancelled with less than 24 hours' notice, or no-shows, may be forfeited.
Where coaching sessions are included as part of a time-limited membership or program, all sessions must be scheduled and used within that period. Unused coaching sessions do not roll over and are forfeited upon membership or program expiry.
The Community exists to support learning, discussion, and peer interaction related to Product Pathways Services
You agree to:
- act respectfully and professionally
- not harass, discriminate, or intimidate others
- not promote, pitch, or solicit without permission
- respect the privacy of other members
We reserve absolute discretion to determine acceptable behaviour.
We may:
- remove content
- restrict participation
- suspend or permanently remove members
Removal for breach of conduct does not entitle you to a refund.
We do not guarantee confidentiality of information shared in the Community. You participate and share information at your own risk.
By posting or submitting content (including comments, questions, testimonials, or feedback), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for operating, improving, and marketing our Services.
This Website may contain links to other sites. Unless expressly stated, these sites are not under the control of Product Pathways or that of Our affiliates. We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them. The inclusion of a link to another site on this Website does not imply our endorsement, support, or sponsorship of the operator of that website nor of the information and/or products which they provide.
Each account is for one individual only
- Sharing accounts is prohibited
- You are responsible for securing your login credentials
We are not liable for unauthorised access caused by your failure to secure your account.
Prices are displayed on the sales page and may be changed at any time. Unless otherwise stated, prices are shown in USD.
Where Services are offered as subscriptions:
- billing recurs automatically
- you are responsible for managing cancellation
- failed payments may result in suspended access
If you have a concern about a charge, you agree to contact us first at learn@productpathways.com before initiating a chargeback or payment dispute with your bank or payment provider. We commit to responding to billing inquiries within 5 business days.
If you initiate a chargeback or payment dispute, we reserve the right to suspend your access to all Services pending resolution. Fraudulent or abusive chargebacks (where Services were delivered as described and no valid refund request was made) may result in permanent account termination, collection action for amounts owed, and reporting to fraud prevention services.
Where stated, a money-back guarantee applies subject to the conditions below.
Refunds may be pro-rated where:
- any live coaching session has been attended or forfeited due to no-show
- more than 50% of course modules or content has been accessed
- a cohort program has commenced (first live session has occurred)
- more than 5 posts, likes or comments have been made in the Community
- any downloadable assets have been accessed or downloaded
Refunds exclude any payment processing fees.
We track content access through our Platform. The determination of whether refund thresholds have been met is made by us in our sole discretion based on Platform usage data. Our records of access and usage are conclusive for the purposes of refund eligibility.
EU consumers may have statutory cooling-off rights. Where digital access has commenced, you acknowledge that those rights may be limited or waived.
All Content remains the intellectual property of Product Pathways Pty Ltd or its licensors. Nothing in these Terms transfers ownership of any intellectual property to you.
Use of the Services is governed by our Privacy Policy at https://www.productpathways.com/privacyWe collect and use personal information in accordance with the Australian Privacy Act 1988 and, where applicable, GDPR.
- Services are provided "as is" and "as available"
- We make no warranties regarding accuracy, fitness for purpose, or uninterrupted access
- You are responsible for your own decisions and actions
To the maximum extent permitted by law:
- we are not liable for indirect or consequential loss
- our total liability is limited to the amount paid by you for the relevant Service
Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemic, government actions, internet or telecommunications failure, or platform outages.
We may suspend or terminate access:
- for breach of these Terms
- for misuse of Content or Community
- at our reasonable discretion
Upon termination:
- access to Services ceases
- licences granted under these Terms end
- no refunds are payable unless required by law
We may update Services or these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.
These Terms, together with our Privacy Policy and any specific terms on the relevant sales page at the time of purchase, constitute the entire agreement between you and Product Pathways regarding the Services.
No prior or contemporaneous communications, whether oral or written, including but not limited to emails, webinar statements, social media posts, direct messages, or other marketing materials, form part of this agreement unless expressly incorporated by reference in these Terms.
If there is any conflict between these Terms and any other communication, these Terms prevail.
By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
